TERMS & CONDITIONS (ULTIMUTT APP)
1. INTRODUCTION
These Terms of Use (“Terms”) constitute a legally binding agreement between:
Ultimutt Petcare Private Limited, a company incorporated under the Companies Act, 2013 (“Company”, “Ultimutt”, “We”, “Us”, “Our”)
and You (“User”, “Pet Parent”, “Customer”).
By accessing, downloading, registering, or using the Ultimutt mobile application, website, or services (collectively, the “Platform”), you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. NATURE OF SERVICES
Ultimutt Petcare Private Limited operates as:
- A direct provider of pet care services, including grooming and boarding; and/or
- A technology platform facilitating connections between users and third-party service providers.
The Company reserves the right to determine whether services are provided directly or through third-party partners. The Company shall not be liable for acts, omissions, or deficiencies of third-party providers beyond reasonable diligence.
SECTION A: GROOMING SERVICES
3. CONSENT AND DISCLOSURE
By booking grooming services, you represent and warrant that:
- You have disclosed all relevant medical, behavioral, and health information regarding your pet;
- Your pet is fit for grooming services.
You acknowledge and accept inherent risks, including but not limited to:
- Minor cuts, clipper irritation, or skin redness
- Allergic or product-related reactions
- Stress-related responses
- Discovery of underlying skin or coat conditions
This consent applies to the current and all future grooming services unless expressly revoked in writing. (Aligned with existing grooming consent framework )
4. LIMITATION OF LIABILITY
Ultimutt shall not be liable for:
- Pre-existing conditions
- Undisclosed medical or behavioral issues
- Natural or unavoidable reactions during grooming
- Liability shall arise only in cases of proven gross negligence.
5. SERVICE MODIFICATION OR REFUSAL
The Company reserves the right to:
- Modify the scope of grooming services; or
- Refuse or discontinue services
- if the pet poses a safety risk or is deemed unfit for grooming.
No refund shall be applicable in such cases.
6. CANCELLATION AND REFUND POLICY
- Cancellations made less than 2 hours before the scheduled time are non-refundable
- Eligible cancellations may be adjusted as service credits at the Company’s discretion
- Completed services are non-refundable
7. MEDIA CONSENT
You grant the Company a perpetual, irrevocable, royalty-free license to use images and videos of your pet for marketing, promotional, and commercial purposes.
SECTION B: BOARDING SERVICES
8. ELIGIBILITY REQUIREMENTS
- You agree that:
- Vaccinations are up to date
- Anti-tick treatment has been administered
- The pet is not suffering from contagious conditions
- The pet does not exhibit aggressive behavior
- The Company reserves the right to refuse admission at its sole discretion.

9. ACKNOWLEDGEMENT OF RISKS
- You acknowledge that:
- Minor injuries may occur during interaction with other pets
- Behavioral or dietary changes may occur
- Post-boarding adjustments are normal

10. CHECK-IN, CHECK-OUT AND BILLING
- Check-in and check-out are permitted only during operational hours
- Boarding is charged on a 24-hour basis
- Delays beyond 2 hours may attract additional charges
11. MEDICAL AUTHORIZATION
- You authorize the Company to:
- Seek veterinary consultation
- Approve treatment in case of emergency if you are unreachable
- You agree that:
- All costs shall be borne by you
- Medical decisions taken in good faith shall be final

12. LIABILITY WAIVER
- The Company shall not be liable for:
- Illness, injury, or death arising during boarding
- Incidents between animals
- Unforeseen health complications
- Except in cases of proven gross negligence.
13. PAYMENT TERMS
- Full advance payment is required to confirm booking
- Payments are non-refundable and non-transferable
- The Company reserves the right to initiate legal recovery for unpaid dues
SECTION C: TRANSPORT AND THIRD-PARTY SERVICES
The Company may engage third-party vendors for transportation or other services. The Company shall not be liable for delays, damages, or incidents arising from such third-party services beyond reasonable control.
SECTION D: GENERAL TERMS
14. INDEMNITY
- You agree to indemnify and hold harmless Ultimutt Petcare Private Limited from any claims, damages, liabilities, or expenses arising from:
- Your pet’s behavior
- Inaccurate or incomplete disclosures
- Breach of these Terms
15. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company’s total liability shall not exceed the amount paid by you for the relevant service.
16. ACCOUNT SUSPENSION
- The Company reserves the right to suspend or terminate accounts for:
- Abuse or misconduct
- Fraudulent activity
- Violation of applicable laws or these Terms
17. GOVERNING LAW AND DISPUTE RESOLUTION
- These Terms shall be governed by the laws of India.
- Jurisdiction: Courts in Delhi
- Dispute resolution: Arbitration, where applicable
18. FORCE MAJEURE
The Company shall not be liable for failure or delay caused by events beyond its reasonable control, including but not limited to natural disasters, governmental actions, or public health emergencies.
19. MODIFICATIONS
The Company reserves the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.
